Welcome to Mindset Integrated. These Terms and Conditions ("Terms") govern your access to and use of the mindsetintegrated.com website, our clinical SaaS platforms (including QLuminate™, Quantify®, and CaseReview), and our litigation support services. By accessing or using our services, you agree to be bound by these Terms.

1. Medical and Legal Disclaimers

Not a Final Medical Diagnosis: Mindset Integrated provides advanced neuroimaging data analysis, DICOM processing, and fractional anisotropy (FA) quantification. Our software and reports are designed to assist trained medical professionals and radiologists. They do not constitute a standalone medical diagnosis, nor do they replace the clinical judgment of a licensed healthcare provider.

Not a Guarantee of Legal Outcomes: While our expert witness services and quantitative reports are designed to provide objective evidence for Traumatic Brain Injury (TBI) litigation, Mindset Integrated does not guarantee the admissibility of reports in any specific jurisdiction or the outcome, settlement value, or success of any legal proceeding.

2. Software as a Service (SaaS) License

Subject to your compliance with these Terms and applicable Business Associate Agreements (BAAs) or Service Agreements, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our cloud-based software tools (CaseReview, QLuminate™, Quantify®) strictly for your internal business, clinical, or legal operations. You may not:

• Reverse-engineer, decompile, or disassemble our software or proprietary control databases.
• Share login credentials across multiple unassociated practices or unauthorized users.
• Resell, sublicense, or distribute our reports or software access without explicit written consent.

3. User Obligations and Data Uploads

When uploading DICOM imaging files, medical records, or any other data to our cloud infrastructure, you represent and warrant that:

• You have the legal right, patient consent, and authorization required by applicable health privacy laws (such as HIPAA) to share this data with us.
• The data uploaded does not contain malicious code, viruses, or software intended to damage or breach our cloud computing environment.

Mindset Integrated reserves the right to suspend or terminate accounts that violate data security protocols or upload unauthorized materials.

4. Intellectual Property

All content, software algorithms, report formatting, proprietary databases (including our 1,000+ healthy controls database), text, graphics, and logos provided by Mindset Integrated are the exclusive intellectual property of Mindset Integrated and are protected by applicable copyright, trademark, and trade secret laws.

5. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Mindset Integrated, its directors, employees, or expert consultants be liable for any indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with the use of our website, software, or analytical reports.

6. Governing Law

These Terms and any dispute arising out of your use of our services shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions. Any legal action or proceeding related to our services shall be brought exclusively in the state or federal courts located in New Mexico.
